| dc.description.abstract | Sosyal ve kültürel birikimlerin ifade biçimlerinden biri olan sanat, insanların yaşamlarını zenginleştirmesi bakımından bireysel bir öneme; toplumsal politikaların yönlendirilmesi ve şekillenmesi noktasında ise toplumsal bir öneme sahiptir. Sanatsal faaliyetleri ile sanatçılar da, yaratıcı ve eleştirel bakış açıları ile toplumun ilerlemesine katkı sunmaktadırlar. Bu bakımdan, sanata ve sanatçıya gereken önemi ve değeri veren toplumlar sosyal, kültürel ve endüstriyel alanda da ilerleme kaydetmektedir. Ülkemizde, sanat ve sanatçının korunması konusunda devlete anayasal düzeyde sorumluluk yüklenmiştir. Sanatçı haklarının korunup geliştirilmesi, bu sorumluluğun hayata geçirilebilmesi bakımından da önem arz etmektedir. Bu çalışmada, toplumların değişim ve gelişim süreçleri bakımından önemli bir role sahip olan sanatçıların çalışma, iş sözleşmesi yapma ve ücret hakları açısından durumları incelenerek, konuya ilişkin gerek mevzuat, gerekse uygulamadan kaynaklanan sorun ve eksiklikler belirlenmeye çalışılmıştır. Söz konusu sorun ve eksiklikler idari ve hukuksal boyutta bazı tedbirlerin alınmasını gerekli kılmaktadır. Bu çerçevede, bu çalışma ile sanatçıların çalışma ilişkilerine ilişkin haklarının korunması ve geliştirilmesi bakımından ortaya konulacak çabalara ve özellikle hukuksal düzeyde atılacak adımlara katkı sunulması hedeflenmiştir. | en_US |
| dc.description.abstract | Art, which is one of the expressions of social and cultural accumulation, has an individual importance in terms of enriching people's lives; it has a social importance in terms of directing and shaping social policies. With their artistic activities, artists also contribute to the advancement of society through creative and critical perspectives. In this respect, the societies that give importance to art and the artist have made progress in social, cultural and industrial fields. In our country, the state has taken responsibility for the protection of art and the artist on the constitutional level. Preserving and improving the rights of artists is also important for the realization of this responsibility. In this study, it has been tried to determine the problems and deficiencies related to the subject matter both in terms of legislation and application by examining the status of artists who have an important role in the process of change and development of societies in terms of working, employment contract and wage rights. These problems and deficiencies require some measures in administrative and legal dimensions. In this framework, this study aims to contribute to the efforts to be taken in terms of protecting and developing the rights of the artists in relation to working relations and in particular the steps to be taken at the legal level. | en_US |
